1. Scope of Services
TOA SURFACE SOLUTIONS provides professional surface solutions such as but not limited to cleaning services including that includes various substrates such as concrete, exposed aggregate, paver, driveway, walkway, patio and outdoor surface cleaning.
Services are limited to cleaning only and do not include repairs, restoration, resurfacing, sealing, landscaping, construction works or maintenance of damaged surfaces unless specifically agreed in writing.
2. Quotes and Pricing
All quotations are valid for thirty (30) days from the date issued unless otherwise stated. Quoted prices are based on the information available at the time of inspection or customer enquiry. Additional charges may apply where site conditions differ significantly from those originally disclosed.
A minimum service charge may apply to all jobs.
TOA SURFACE SOLUTIONS may require a deposit prior to commencement of works where deemed necessary. Deposit requirements, if applicable, will be specified in the quotation, estimate or proposal. Acceptance of the quotation constitutes acceptance of any specified deposit requirements.
3. Site Access and Customer Responsibilities
The customer is responsible for ensuring safe and reasonable access to all work areas. Prior to commencement, customers must remove or relocate vehicles, furniture, bins, toys, garden items, decorations and other obstacles from the work area.
Additional labour charges may apply where TOA SURFACE SOLUTIONS is required to move items or prepare the area before work can commence.
The customer must disclose any known hazards, underground services, fragile surfaces, drainage issues, irrigation systems or other site conditions that may affect the safe performance of the works.
4. Water Supply
Unless otherwise agreed in writing, the customer must provide access to a suitable, operational and unrestricted water supply located within reasonable distance of the work area.
The customer acknowledges that TOA SURFACE SOLUTIONS relies on the customer’s water supply to perform cleaning services and that all quoted pricing is based upon customer-supplied water being available throughout the duration of the works.
If suitable water access is unavailable, interrupted, disconnected, restricted, contaminated or insufficient to complete the works, TOA SURFACE SOLUTIONS reserves the right to postpone, reschedule or discontinue services.
Additional charges may apply where delays, downtime, return visits or rescheduling are required due to unavailable or unsuitable water supply.
5. Surface Condition and Existing Damage
The customer acknowledges that pressure cleaning may expose pre-existing defects including but not limited to:
- Cracked concrete
- Loose pavers
- Deteriorated mortar or grout
- Surface flaking or spalling
- Previous repairs
- Existing stains and discolouration
TOA SURFACE SOLUTIONS accepts no responsibility for damage resulting from pre-existing defects, poor installation, age-related deterioration, inadequate maintenance or latent defects not reasonably visible before commencement of works.
6. Stain Removal
While every effort will be made to improve the appearance of the surface, complete stain removal cannot be guaranteed. Certain stains may be permanent or only partially removable, including but not limited to:
- Oil stains
- Rust stains
- Paint stains
- Tannin stains
- Efflorescence
- Tyre marks
- Deep organic staining
Charges apply for specialised stain treatment services.
7. Surface Cleaning Results
TOA SURFACE SOLUTIONS will perform services using reasonable skill and care. Cleaning results may vary depending on the age, condition, porosity, previous treatments, contamination levels and material composition of the surface.
No guarantee is provided that surfaces will be restored to a like-new condition or that all stains, marks, biological growth, mould, algae, mildew or discolouration will be completely removed.
8. Chemical Treatments
Professional cleaning chemicals may be used where necessary to achieve satisfactory cleaning results.
Customers must advise of any sensitive plants, surfaces, materials, pets, water features, environmental concerns or chemical sensitivities prior to commencement.
Reasonable precautions will be taken; however, TOA SURFACE SOLUTIONS accepts no responsibility for issues arising from undisclosed site conditions.
9. Drainage and Run-Off
TOA SURFACE SOLUTIONS recognises its obligations to manage wastewater and run-off in an environmentally responsible manner.
TOA SURFACE SOLUTIONS will take reasonable and practicable steps to prevent contaminated wastewater, chemicals, debris, organic matter and cleaning residues from entering stormwater systems, waterways or environmentally sensitive areas.
Where required, suitable control measures may be implemented to contain, divert, recover or manage wastewater generated during cleaning operations.
The customer acknowledges that cleaning activities may generate water, dirt, organic matter and cleaning residues which require management throughout the works.
TOA SURFACE SOLUTIONS accepts no responsibility for existing drainage defects, blocked stormwater systems, inadequate site drainage, flooding, overflow or damage arising from pre-existing site conditions.
The customer is responsible for advising TOA SURFACE SOLUTIONS of any known drainage issues, environmental sensitivities, stormwater concerns or site conditions that may affect the safe performance of the works prior to commencement.
10. Weather Conditions
Services may be postponed, interrupted or rescheduled due to weather conditions, safety concerns or circumstances beyond reasonable control.
TOA SURFACE SOLUTIONS shall not be liable for delays resulting from weather events or other circumstances beyond its reasonable control.
11. Photographs
TOA SURFACE SOLUTIONS may take photographs of work areas before, during and after service completion for quality assurance, training, record keeping, insurance, operational and marketing purposes.
Property photographs may be retained as part of company business records and managed in accordance with the TOA SURFACE SOLUTIONS Privacy Policy.
No personal information will be disclosed without consent.
Customers may request in writing that photographs of their property not be used for marketing purposes.
12. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing or specified within an approved commercial credit arrangement.
Accepted payment methods include:
- Credit or Debit Card
- Electronic Funds Transfer (EFT)
- Cash
Ownership of any reports, photographs or documentation remains with TOA SURFACE SOLUTIONS until payment has been received in full.
Invoices remaining unpaid beyond the agreed payment period may incur collection costs, recovery action, interest charges and any reasonable legal expenses incurred in recovering outstanding monies.
13. Limitation of Liability
To the maximum extent permitted by law, TOA SURFACE SOLUTIONS shall not be liable for:
- Pre-existing surface defects
- Permanent staining
- Natural wear and tear
- Damage resulting from faulty installation or maintenance
- Damage arising from undisclosed site conditions
- Indirect, incidental or consequential losses
Liability is limited to the value of the services provided.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantees, rights or remedies available under the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot lawfully be excluded.
14. Acceptance of Quotation & Terms
Acceptance of any quotation, estimate, proposal or booking issued by TOA SURFACE SOLUTIONS, whether electronically, in writing or verbally, constitutes acknowledgement and acceptance of these Terms and Conditions in full.
Where an estimate or quotation is issued through an electronic platform, including Square, the customer’s acceptance of the estimate shall be deemed acceptance of these Terms and Conditions and shall form a binding agreement between the customer and TOA SURFACE SOLUTIONS.
By accepting an estimate, the customer confirms they have read, understood and agreed to these Terms and Conditions prior to the commencement of works.
15. Complaints and Customer Concerns
TOA SURFACE SOLUTIONS is committed to providing professional and high-quality services.
Any customer concerns, complaints or disputes relating to services provided should be raised with TOA SURFACE SOLUTIONS as soon as reasonably practicable following completion of the works.
TOA SURFACE SOLUTIONS will review all complaints objectively and take reasonable steps to investigate and resolve legitimate concerns in accordance with the Company’s Quality Management processes.
16. General
TOA SURFACE SOLUTIONS reserves the right to refuse, postpone or discontinue services where safety risks, abusive behaviour, inaccessible work areas or unforeseen site conditions are encountered.
Personal information collected during the provision of services will be managed in accordance with the TOA SURFACE SOLUTIONS Privacy Policy.
These Terms and Conditions may be updated from time to time, with the version current at the date of quotation applying to the services provided.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia.
